Bu rakam\u0131n ne ifade etti\u011fine daha yak\u0131ndan bakt\u0131\u011f\u0131m\u0131zda g\u00f6rd\u00fc\u011f\u00fcm\u00fcz manzara \u015fudur: 2011 y\u0131l\u0131 ihracat\u0131 135 milyar dolar, ithalat\u0131 241 milyar dolar olan \u00fclkenin t\u00fcm ithalat\u0131n\u0131n be\u015fte birinden fazlas\u0131n\u0131 enerji olu\u015fturmakta, ihracattan kazand\u0131\u011f\u0131 b\u00fct\u00fcn paran\u0131n da neredeyse yar\u0131s\u0131 buna gitmektedir. Fakat bu a\u011f\u0131r d\u0131\u015f ticaret dengesizli\u011fini daha da korkutucu k\u0131lan as\u0131l geli\u015fme, enerji ithalat\u0131ndaki art\u0131\u015f\u0131n, hem miktar hem de fiyat olarak, toplam ihracat ve ithalat art\u0131\u015flar\u0131n\u0131 katl\u0131yor olmas\u0131d\u0131r. 2011 y\u0131l\u0131nda \u00fclkenin t\u00fcm ihracat\u0131 \u00f6nceki y\u0131la g\u00f6re % 18,5 ve ithalat\u0131 da % 29 artarken, enerji faturas\u0131 bir \u00f6nceki y\u0131la g\u00f6re % 40,5 artm\u0131\u015ft\u0131r!<b>(<a title=\"\" href=\"file:\/\/\/C:\/Users\/onurtoy\/Downloads\/returkiyeningereklemeyendmakalesi_yaynhazrl\/%5bD%C3%9CZENLEND_%5dTurkiyenin%20Gerceklesmeyen%20Dusu%20Petrol.RT2013.SONVERSIYON.ceviri.doc#_ftn3\">[3]<\/a>)<\/b> Enerji ithalat\u0131 i\u00e7in \u00f6dedi\u011fi y\u00fcksek faturalar olmasa, \u00fclkenin son birka\u00e7 y\u0131ldaki (eskiye g\u00f6re) h\u0131zl\u0131 b\u00fcy\u00fcmesi \u00e7ok daha hayranl\u0131k verici bir noktaya \u00e7\u0131kabilirdi. Ba\u015fbakan (ve iktidar partisinin \u00f6teki s\u00f6zc\u00fcleri) Moddy\u2019s, Fitch ve S&amp;P\u2019nin \u00fclkeye verdikleri kredi notunu az buluyor, ama bu uluslararas\u0131 derecelendirme kurulu\u015flar\u0131 da s\u00fcrekli (ve de hakl\u0131) olarak \u201ccari a\u00e7\u0131ktan ne haber?\u201d deyip duruyorlar.<\/p>\n<p style=\"text-align: justify;\">T\u00fcrkleri bu fakirli\u011fe isyan ettiren neden ise b\u00fct\u00fcn kom\u015fular\u0131 petrol ve do\u011falgaz i\u00e7inde y\u00fczerken do\u011fan\u0131n kendilerine b\u00f6ylesine cimri davranm\u0131\u015f olmas\u0131. \u201c\u0130ran\u2019da, Irak\u2019ta, Azerbaycan\u2019da, Rusya\u2019da bunca bol olan \u015fey neden bizde yok?\u201d sorusuna yan\u0131t bulam\u0131yorlar. Bu isyan tek ba\u015f\u0131na pek de zararl\u0131 olmayabilir; ama b\u00fct\u00fcn yeralt\u0131 kaynaklar\u0131 i\u00e7in ge\u00e7erli ba\u015fka bir yayg\u0131n septik d\u00fc\u015f\u00fcnce daha var ki i\u015fte o petrol ve do\u011falgaz arama \u00e7abalar\u0131n\u0131n \u00f6n\u00fcnde ger\u00e7ekten de ciddi bir engeldir: Yer alt\u0131 zenginliklerimizi yer \u00fcst\u00fcne \u00e7\u0131karmak isteyen herkese kar\u015f\u0131, tedavi kabul etmez bir \u015f\u00fcphe duymak! Bu hastal\u0131\u011fa sadece k\u00f6y kahvelerinde de\u011fil, ciddi siyasal tart\u0131\u015fmalarda, a\u00e7\u0131k oturumlarda bile rastlayabilirsiniz. S\u00f6z gelimi yabanc\u0131 petrol \u015firketi kuyu a\u00e7t\u0131, fakat petrol bulamad\u0131 ya da buldu\u011fu miktar ekonomik olmaktan \u00e7ok uzak, o y\u00fczden kuyuyu \u00e7imentoyla kapat\u0131p gitti. \u0130\u015fte bu olaya y\u00f6re halk\u0131n\u0131n yakla\u015f\u0131m\u0131 kesinlikle \u015f\u00f6yle olacakt\u0131r: \u201cAsl\u0131nda petrol\u00fc buldular, ama s\u0131rf bize yaramas\u0131n diye kuyuyu kapat\u0131p gittiler!\u201d Bu inan\u0131\u015f kar\u015f\u0131s\u0131nda yapaca\u011f\u0131n\u0131z b\u00fct\u00fcn mant\u0131kl\u0131 a\u00e7\u0131klamalar ge\u00e7ersizdir; onlarca milyon dolar harcay\u0131p a\u00e7t\u0131\u011f\u0131 kuyuda ekonomik \u00f6l\u00e7\u00fcde petrol bulan herhangi bir \u00f6zel \u015firketin, bunu \u00e7\u0131karmaktan hi\u00e7bir ko\u015fulda vazge\u00e7meyece\u011fine insanlar\u0131 inand\u0131ramazs\u0131n\u0131z. Halk aras\u0131nda yerle\u015fik \u00e7ok ilgin\u00e7 bir ba\u015fka inan\u0131\u015f da \u015fudur: Asl\u0131nda uzaydaki uydulardan T\u00fcrkiye\u2019deki b\u00fct\u00fcn petrol yataklar\u0131, maden kaynaklar\u0131 \u00e7\u0131plak g\u00f6zle bile a\u00e7\u0131k\u00e7a g\u00f6r\u00fclmektedir, ama yabanc\u0131lar kas\u0131tl\u0131 olarak bu bilgiyi bizden gizlemektedirler!<\/p>\n<p style=\"text-align: justify;\">T\u00fcrkiye\u2019de ge\u00e7erli abart\u0131 merak\u0131 ve piyango d\u00fc\u015fk\u00fcnl\u00fc\u011f\u00fc de bilimsel analizleri suland\u0131ran etkenler aras\u0131ndad\u0131r. Zaman zaman bulunan k\u00fc\u00e7\u00fcc\u00fck do\u011falgaz yataklar\u0131n\u0131n \u201cB\u00fct\u00fcn \u00fclkeyi kurtaracak kadar b\u00fcy\u00fck\u201d oldu\u011funu s\u00f6yleyen genel m\u00fcd\u00fcrlerimiz oldu. Halk\u0131n \u00e7o\u011fu da g\u00fcn\u00fcn birinde Tanr\u0131n\u0131n i\u015fi ele alaca\u011f\u0131na ve topraklar\u0131m\u0131zda e\u015fine rastlanmayacak \u00f6l\u00e7\u00fcde zengin do\u011fal kaynaklar ke\u015ffedece\u011fimize inanmay\u0131 s\u00fcrd\u00fcrmektedir. (Hatta bor madeninde bu ger\u00e7ekle\u015fmi\u015ftir bile.) K\u0131sacas\u0131, \u201cbizim evde\u201d petrol ve do\u011falgaz konusunda ak\u0131lc\u0131 de\u011ferlendirmeler yapmak pek kolay olmuyor.<\/p>\n<p style=\"text-align: center;\"><b>Kutsal Petrol, Kutsal Milli Menfaatler<\/b><\/p>\n<p style=\"text-align: justify;\">T\u00fcrkiye\u2019de uzun y\u0131llardan beri ge\u00e7erli olan petrol ve do\u011falgaz arama rejimini de\u011fi\u015ftirmek i\u00e7in \u015fimdilerde yeni bir yasa tasar\u0131s\u0131 TBMM Genel Kuruluna sunulmu\u015f durumda. 6326 say\u0131l\u0131\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u00a0(art\u0131k \u201ceski\u201d diyelim) Petrol Kanunu 1954 tarihliydi; en kapsaml\u0131lar\u0131 1970 ve 1983\u2019te olmak \u00fczere pek \u00e7ok kez de\u011fi\u015ftirilmi\u015f, ama yine de epeyce eski kalm\u0131\u015ft\u0131. En \u00f6nemli \u00f6zelli\u011fi ise \u201ca\u015f\u0131r\u0131 korumac\u0131\u201d tavr\u0131yd\u0131.<\/p>\n<p style=\"text-align: justify;\">Eski yasaya g\u00f6re T\u00fcrkiye\u2019de petrol arama i\u015fi neredeyse \u201ckutsal\u201d bir faaliyetti, bu faaliyet ancak devlet \u015firketi TPAO taraf\u0131ndan yap\u0131labilirdi, ba\u015fka yerli ve yabanc\u0131 \u015firketlere \u00e7ok zor izin veriliyordu. \u201cMilli menfaatlere uygunluk\u201d kriterine a\u015f\u0131r\u0131 vurgu yap\u0131lmaktayd\u0131, ba\u015fvurular\u0131n de\u011ferlendirilmesinde ba\u015fta gelen \u00f6l\u00e7\u00fct buydu.<\/p>\n<p style=\"text-align: justify;\">Yabanc\u0131 petrol \u015firketleri neredeyse \u201cajan\u201d gibi alg\u0131lanmaktayd\u0131. Eski yasa bu ku\u015fkuyu son derece mu\u011flak ifadelerle \u015f\u00f6yle form\u00fcle etmi\u015fti: E\u011fer bir \u015firketin idaresinde yabanc\u0131 bir devletin \u201cmali ilgisi\u201d varsa, o \u015firketin T\u00fcrkiye\u2019de petrol aramas\u0131 m\u00fcmk\u00fcn de\u011fildi. B\u00f6yle \u015firketler petrole ili\u015fkin \u00f6teki faaliyetleri de y\u00fcr\u00fctemezler, bu ama\u00e7la menkul ve gayrimenkuller edinemezlerdi. (\u00c7ok gerekli hallerde bu izni onlara ancak bakanlar kurulu verebilirdi.) Bu h\u00fckm\u00fc \u015f\u00f6yle a\u00e7\u0131klayal\u0131m: S\u00f6z gelimi Kazakistan\u2019da bu h\u00fck\u00fcm ge\u00e7erli olsayd\u0131, T\u00fcrk devlet \u015firketi TPAO orada de\u011fil petrol aramak, irtibat b\u00fcrosu bile a\u00e7amayacakt\u0131! Petrol \u015firketleri \u00e7\u0131kard\u0131klar\u0131 petrol\u00fcn ancak karada % 35\u2019ini, denizde ise % 45\u2019ini ihra\u00e7 edebiliyorlard\u0131. Geri kalan\u0131 \u201c\u00fclke gereksinimi\u201d i\u00e7in ay\u0131rmak zorundayd\u0131lar.<\/p>\n<p style=\"text-align: justify;\">Eski yasa, ulusal petrol \u015firketi TPAO\u2019ya \u00e7e\u015fitli ayr\u0131cal\u0131klar tan\u0131nmaktayd\u0131; TPAO sahip oldu\u011fu i\u015fletme ruhsatlar\u0131n\u0131 s\u00fcresiz bi\u00e7imde elinde tutabiliyor, sahip olabilece\u011fi ruhsat say\u0131s\u0131 bak\u0131m\u0131ndan da \u00f6teki \u015firketlerden avantajl\u0131 konumda bulunuyordu. \u00dczerinde i\u015fletme ruhsat\u0131 bulunmayan petroll\u00fc araziler ihaleye \u00e7\u0131kar\u0131lmaks\u0131z\u0131n TPAO\u2019ya teklif edilir, o kabul ederse art\u0131k ba\u015fkas\u0131na sorulmazd\u0131. Ruhsat s\u00fcresi biten \u015firketlerin \u00fcretim sahalar\u0131 da sorgusuz sualsiz TPAO\u2019ya devredilirdi.<\/p>\n<p style=\"text-align: justify;\">Petrol \u015firketleri, petrol arama\/\u00e7\u0131karma harcamalar\u0131n\u0131n geri d\u00f6n\u00fc\u015f\u00fcn\u00fc \u00e7ok uzun zamana yaymak zorundayd\u0131lar ve y\u00fcksek oranl\u0131 kurumlar vergisine tabiydiler. Vergi \u00fcst s\u0131n\u0131r\u0131n\u0131n % 55\u2019lere kadar \u00e7\u0131kmas\u0131 m\u00fcmk\u00fcnd\u00fc.<\/p>\n<p style=\"text-align: justify;\">Bu ve benzeri h\u00fck\u00fcmler,\u00a0 her kar\u0131\u015f topra\u011f\u0131ndan petrol f\u0131\u015fk\u0131ran Irak\u2019ta ge\u00e7erli olsa pek sorun te\u015fkil etmeyebilirdi, ama T\u00fcrkiye\u2019de hakl\u0131 olarak \u015firketleri hep korkuttu.<\/p>\n<p style=\"text-align: justify;\">Yasa b\u00f6ylesine \u201cistekli ka\u00e7\u0131ran\u201d kurallar yan\u0131nda, alabildi\u011fine bo\u015fluklarla da doluydu ve bu bo\u015fluklar k\u00f6t\u00fc niyetlere kap\u0131 a\u00e7abiliyordu. \u00d6rne\u011fin, arama ruhsatnameleri herhangi bir i\u015f program\u0131na (ve teminata) ba\u011flanm\u0131yordu, \u015firketler dilerlerse ruhsat s\u00fcresinin son ay\u0131na kadar bo\u015f oturabilir ve petrol sahas\u0131n\u0131 y\u0131llarca ellerinde tutabilirlerdi.\u00a0 Bu bo\u015fluktan yararlanan sahte petrolc\u00fcler,\u00a0 ellerindeki ruhsatlar\u0131 karaborsada pazarlamaktayd\u0131lar.<b><\/b><\/p>\n<p style=\"text-align: center;\"><b>Korumac\u0131l\u0131k \u0130\u015fe Yarad\u0131 m\u0131?<\/b><\/p>\n<p style=\"text-align: justify;\">\u201cBu korumac\u0131 yasa y\u00fcr\u00fcrl\u00fckte kald\u0131\u011f\u0131 s\u00fcre i\u00e7inde \u00fclkenin petrol arama-bulma-i\u015fletme bil\u00e2n\u00e7osu nas\u0131l geli\u015fti?\u201d sorusunun yan\u0131t\u0131 ise hi\u00e7 de i\u00e7 a\u00e7\u0131c\u0131 de\u011fil.<\/p>\n<p style=\"text-align: justify;\">1954 y\u0131l\u0131ndan bu yana T\u00fcrkiye\u2019de sadece 4.103 arama ve \u00fcretim kuyusu a\u00e7\u0131labilmi\u015ftir. 2011 itibariyle bunlar\u0131n faal olan 1.180\u2019inden elde edilebilen ham petrol sadece 2,3 milyon ton kadar olabilmi\u015ftir.<b> (<a title=\"\" href=\"file:\/\/\/C:\/Users\/onurtoy\/Downloads\/returkiyeningereklemeyendmakalesi_yaynhazrl\/%5bD%C3%9CZENLEND_%5dTurkiyenin%20Gerceklesmeyen%20Dusu%20Petrol.RT2013.SONVERSIYON.ceviri.doc#_ftn4\">[4]<\/a>)<\/b> \u00dclkedeki t\u00fcm kuyular\u0131n ortalama verimlili\u011fi 38 varil\/g\u00fcn kadard\u0131r. En \u00e7ok \u00fcretim yap\u0131lan kuyunun g\u00fcnl\u00fck verimi 698 varildir ve 1 varil\/g\u00fcn \u00fcretim yapan kuyular\u0131m\u0131z bile vard\u0131r.<b>(<a title=\"\" href=\"file:\/\/\/C:\/Users\/onurtoy\/Downloads\/returkiyeningereklemeyendmakalesi_yaynhazrl\/%5bD%C3%9CZENLEND_%5dTurkiyenin%20Gerceklesmeyen%20Dusu%20Petrol.RT2013.SONVERSIYON.ceviri.doc#_ftn5\">[5]<\/a>)<\/b> 2011\u2019de \u00e7\u0131karabildi\u011fimiz t\u00fcm do\u011falgaz\u0131n da 283 kuyudan geldi\u011fini not edelim. Bu kuyu kalabal\u0131\u011f\u0131 ve bunlardan elde edilebilen k\u00fc\u00e7\u00fcc\u00fck \u00fcretim, T\u00fcrkiye topraklar\u0131n\u0131n petrol \u015firketleri i\u00e7in pek de \u00f6yle \u201ctercihe de\u011fer\u201d bir co\u011frafya olmad\u0131\u011f\u0131n\u0131 g\u00f6steriyor. \u015eimdiye kadar a\u00e7\u0131labilmi\u015f kuyu say\u0131s\u0131 780.000 km2\u2019lik koca \u00fclke i\u00e7in \u00e7ok yetersizdir, denizlerimiz h\u00e2l\u00e2 b\u00fcy\u00fck \u00f6l\u00e7\u00fcde bakir, dolay\u0131s\u0131yla g\u00fcn\u00fcn birinde \u201c\u00e7ok verimli\u201d alanlar ke\u015ffetme \u00fcmidimizi hen\u00fcz kaybetmedik, ama d\u00f6rt bin k\u00fcsur kuyuluk deneyimlerimiz \u0131\u015f\u0131\u011f\u0131nda, bu pek de yak\u0131n bir olas\u0131l\u0131k de\u011fildir.<b><\/b><\/p>\n<p style=\"text-align: center;\"><b>Cumhurba\u015fkan\u0131n\u0131n Vetosu, Meclisin Umursamazl\u0131\u011f\u0131 <\/b><\/p>\n<p style=\"text-align: justify;\">Eski yasadan \u015fik\u00e2yetler y\u0131llard\u0131r s\u00fcr\u00fcyordu, 2004 y\u0131l\u0131n\u0131n Haziran ay\u0131nda TBMM\u2019ye sunulan bir yasa tasar\u0131s\u0131, 2,5 y\u0131l meclis komisyonlar\u0131nda s\u00fcr\u00fcnd\u00fckten sonra, ancak 17 Ocak 2007 tarihinde kabul edilebildi. 5574 say\u0131l\u0131 bu yasa:<\/p>\n<ul>\n<li>\u201cUlusal \u00e7\u0131karlara uygunluk\u201d kavram\u0131na yer vermiyordu.<\/li>\n<li>\u00c7\u0131kar\u0131lacak petrol\u00fcn bir k\u0131sm\u0131n\u0131n \u00fclke gereksinimlerine ayr\u0131laca\u011f\u0131 kural\u0131 yoktu.<\/li>\n<li>\u201cYabanc\u0131 bir devletle mali ilgisi olan\u201d \u015firketler i\u00e7in konulan yasak kald\u0131r\u0131lm\u0131\u015ft\u0131.<\/li>\n<li>Eski yasada % 12,5 olan devlet hissesinde kademeli bir sistem kabul ediliyordu. Devlet hissesi karalarda ve denizlerde farkl\u0131 belirlenecek, ayr\u0131ca \u00fcretim miktar\u0131yla da ili\u015fkili olacakt\u0131. % 2\u2019den ba\u015flayan ve % 12\u2019ye kadar \u00e7\u0131kan bir rejim \u00f6ng\u00f6r\u00fclmekteydi.<\/li>\n<li>Karalarda elde edilen devlet hissesinin % 50\u2019sinin, petrol\u00fcn \u00e7\u0131kar\u0131ld\u0131\u011f\u0131 ilin \u00f6zel y\u00f6netimine aktar\u0131lmas\u0131 kabul edilmekteydi.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Yasa, zaman\u0131n cumhurba\u015fkan\u0131 taraf\u0131ndan, yukar\u0131da belirtti\u011fimiz 5 noktada toplanan gerek\u00e7elerle veto edildi. \u00a0Yani Cumhurba\u015fkan\u0131 yasadaki b\u00fct\u00fcn yenilik\u00e7i noktalara itiraz ediyordu.<\/p>\n<p style=\"text-align: justify;\">T\u00fcrkiye Cumhuriyetinin anayasal sisteminde Cumhurba\u015fkan\u0131 vetosu Meclis iradesinin \u00f6n\u00fcnde ger\u00e7ek bir engel olu\u015fturmaz. Meclis dilerse vetoya direnebilir, yasay\u0131 (virg\u00fcl\u00fcne dokunmadan) tekrar g\u00f6ndererek Cumhurba\u015fkan\u0131n\u0131 onaylamak zorunda b\u0131rakabilir. Tabii yasa \u00fczerinde veto gerek\u00e7elerine uygun de\u011fi\u015fiklikleri yaparak Cumhurba\u015fkan\u0131 ile uzla\u015fmas\u0131 da m\u00fcmk\u00fcnd\u00fcr. Fakat Meclis Petrol Yasas\u0131 i\u00e7in bunlar\u0131n hi\u00e7birini yapmad\u0131, sessiz kalmakla yetindi.<\/p>\n<p style=\"text-align: justify;\">Cumhurba\u015fkan\u0131n\u0131n veto gerek\u00e7eleri aras\u0131nda biri her zaman \u201cyerinde, hakl\u0131\u201d g\u00f6r\u00fclm\u00fc\u015ft\u00fcr ki bu da \u201c\u00fcretilen petrolden al\u0131nan devlet hissesinin yar\u0131s\u0131n\u0131n yerel y\u00f6netimlere b\u0131rak\u0131laca\u011f\u0131\u201d kural\u0131d\u0131r. Ger\u00e7ekten, \u00fcniter bir \u00fclke i\u00e7in do\u011fal kaynaklar\u0131n \u201c\u00e7\u0131kar\u0131ld\u0131\u011f\u0131 b\u00f6lgeye g\u00f6re\u201d da\u011f\u0131t\u0131lmas\u0131 kabul edilebilir de\u011fildi. Fakat konuyla ilgili b\u00fct\u00fcn \u00e7evrelerin \u00fczerinde uzla\u015ft\u0131\u011f\u0131 \u00f6teki yeniliklere Meclisin neden y\u0131llarca sahip \u00e7\u0131kmad\u0131\u011f\u0131, bunlar\u0131 y\u00fcr\u00fcrl\u00fc\u011fe koymak i\u00e7in neden bekledi\u011fi bilinmezli\u011fini koruyor. <b><\/b><\/p>\n<p style=\"text-align: center;\"><b>Yeni Yasa, Yeni D\u00f6nem ve Bir \u00d6ng\u00f6r\u00fc: Hi\u00e7bir \u015eey De\u011fi\u015fmeyecek!<\/b><\/p>\n<p style=\"text-align: justify;\">\u015eimdi TBMM\u2019ye sunulan yeni yasa tasar\u0131s\u0131 2007\u2019den beri uyumaya terk edilen i\u015fte bu \u201cvetolu yasay\u0131\u201d temel al\u0131yor, fakat petrol (ve do\u011falgaz) aramay\u0131 yine de bekledi\u011fimiz kadar \u00f6zendirmeyecek. \u00c7\u00fcnk\u00fc pek \u00e7ok olumlu de\u011fi\u015fiklik i\u00e7erse de en can al\u0131c\u0131 sorunlar\u0131 g\u00f6rmezden geliyor ve baz\u0131 noktalarda 2007\u2019nin bile gerisine d\u00fc\u015fm\u00fc\u015f durumda.<\/p>\n<p style=\"text-align: justify;\">Devlet hissesi hesab\u0131nda \u201cvetolu\u201d 2007 yasas\u0131nda \u00f6ng\u00f6r\u00fclm\u00fc\u015f olan sistemden, yani deniz sondajlar\u0131n\u0131 \u00f6zel olarak cesaretlendiren ve devlet hissesini \u201c\u00e7\u0131kar\u0131lan petrole\u201d endeksleyen kademeli hesaplamadan vazge\u00e7ilmi\u015f ve 1954 yasas\u0131ndaki duruma geri d\u00f6n\u00fclm\u00fc\u015f olmas\u0131 \u00e7ok \u015fa\u015f\u0131rt\u0131c\u0131. Sadece \u00e7ok d\u00fc\u015f\u00fck graviteli petrol i\u00e7in k\u00fc\u00e7\u00fck indirimler yap\u0131labilecek.<\/p>\n<p style=\"text-align: justify;\">Yabanc\u0131 \u015firket fobisi yeni tasar\u0131ya birka\u00e7 yerde yine s\u0131zm\u0131\u015f. Tasar\u0131 petrol hakk\u0131 sahibi olan \u015firketin y\u00f6netim kontrol\u00fcnde de\u011fi\u015fiklik yaratan sermaye hareketlerini bakan\u0131n \u201c\u00f6n onay\u0131na\u201d ba\u011fl\u0131 k\u0131l\u0131yor. (Hisseleri New York borsas\u0131nda al\u0131n\u0131p sat\u0131lan d\u00fcnya devi bir \u015firketin y\u00f6netim kontrol\u00fcn\u00fc izlemek, T\u00fcrkiye\u2019deki petrol kuyusunun g\u00fcnl\u00fck \u00fcretimine ne kazand\u0131racak, kimse bilmiyor.) Bir ba\u015fka fobik s\u0131z\u0131nt\u0131 da \u015fu: Yeni tasar\u0131ya g\u00f6re yabanc\u0131 petrol \u015firketinin mutlaka \u201csermaye \u015firketi\u201d olmas\u0131 gerekiyor. Yani t\u0131pk\u0131 TPAO gibi \u201cdevlet \u015firketi\u201d stat\u00fcs\u00fcnde olanlar bundan b\u00f6yle T\u00fcrkiye\u2019de petrol arayamayabilir.<\/p>\n<p style=\"text-align: justify;\">Devlet hissesinin nakdi olarak tahsilinde kuyu ba\u015f\u0131 fiyat\u0131 yerine piyasa fiyat\u0131n\u0131n esas al\u0131nmas\u0131, \u00fcretici \u015firketler i\u00e7in \u00f6nemli bir haks\u0131zl\u0131k kayna\u011f\u0131 olmaya aday g\u00f6r\u00fcn\u00fcyor. \u00c7\u00fcnk\u00fc piyasa fiyat\u0131 \u00e7\u0131kar\u0131lan petrol\u00fcn en yak\u0131n piyasaya nakil giderlerini de i\u00e7ermektedir ve b\u00f6ylece devlet hissesini kuyunun ba\u015f\u0131nda petrol olarak \u00f6deyen nakden \u00f6deyenden daha k\u00e2rl\u0131 olacakt\u0131r.<\/p>\n<p style=\"text-align: justify;\">Yeni d\u00f6nemin birka\u00e7 olumlu \u00f6ng\u00f6r\u00fcs\u00fc de var. Bunlar\u0131n ba\u015f\u0131nda, arama ruhsatlar\u0131n\u0131n i\u015f programlar\u0131na (ve teminata) ba\u011flamas\u0131 geliyor. Art\u0131k, ruhsatlar\u0131 hi\u00e7bir faaliyet yapmaks\u0131z\u0131n y\u0131llarca elde tutmak tarihe kar\u0131\u015f\u0131yor. Bunu yapanlar hem ceza \u00f6deyecekler, hem de ruhsatlar\u0131n\u0131 kaybedecekler. \u00c7\u0131kar\u0131lan petrol\u00fcn bir k\u0131sm\u0131na konulan ihra\u00e7 yasa\u011f\u0131n\u0131n kald\u0131r\u0131lmas\u0131 da olumlu geli\u015fmeler aras\u0131nda. \u015eirketler, sadece T\u00fcrkiye\u2019nin arz g\u00fcvenli\u011fi bak\u0131m\u0131ndan gerek duyaca\u011f\u0131 petrol\u00fc piyasa fiyat\u0131ndan i\u00e7erde satmak zorunda olacaklar.<\/p>\n<p style=\"text-align: justify;\">Yeni d\u00f6nemde \u015firketler arama giderlerini tamamen geri almad\u0131k\u00e7a, petrol kazan\u00e7lar\u0131ndan vergi \u00f6demeyecekler. Bu belki de yeni d\u00f6nemdeki yeniliklerin ba\u015f\u0131nda geliyor. Fakat \u015firketleri aramaya \u00f6zendirecek en \u00f6nemli unsur neredeyse tamamen pas ge\u00e7ilmi\u015f: Vergi indirimi. % 40\u2019a kadar ula\u015fabilecek vergi oran\u0131, ola\u011fan\u00fcst\u00fc riskli petrol sekt\u00f6r\u00fc i\u00e7in zaten olduk\u00e7a y\u00fcksektir, T\u00fcrkiye co\u011frafyas\u0131n\u0131n en az\u0131ndan \u015fimdilik bilinen rezerv durumu bu riski daha da artt\u0131r\u0131yor. \u015eirketlere, ba\u015far\u0131s\u0131z sondaj masraflar\u0131n\u0131 konsolide edebilecekleri olanaklar\u0131n da yarat\u0131lmas\u0131 do\u011fru olurdu. <b><\/b><\/p>\n<p style=\"text-align: center;\"><b>TPAO\u2019nun Konumu<\/b><\/p>\n<p style=\"text-align: justify;\">Yeni d\u00f6nemin belki de en b\u00fcy\u00fck olumlu yenili\u011fi, \u015fa\u015f\u0131rt\u0131c\u0131 bi\u00e7imde, tasar\u0131ya getirilen ele\u015ftirilerin de oda\u011f\u0131n\u0131 olu\u015fturdu. Art\u0131k, Devlet \u015eirketi TPAO\u2019nun ruhsat sahibi di\u011fer \u015firketlerden fark\u0131 olmayacak. \u201cDevlet ad\u0131na arama yapmak\u201d ayr\u0131cal\u0131\u011f\u0131 kald\u0131r\u0131ld\u0131\u011f\u0131 gibi, \u201cs\u00fcresi sona erecek\u201d i\u015fletme ruhsatlar\u0131n\u0131n m\u00fczayedesiz olarak TPAO\u2019ya devrinden de vazge\u00e7iliyor.<\/p>\n<p style=\"text-align: justify;\">TPAO\u2019nun ayr\u0131cal\u0131klar\u0131n\u0131n s\u00fcrmesinden yana olan profesyonellerin, bu devlet \u015firketinin nas\u0131l \u201cbir d\u00fcnya oyuncusu\u201d olabilece\u011fine kafa yormalar\u0131 daha do\u011fru olacak. Mevcut yasal, y\u00f6netsel (ve tabii ki finansal) yap\u0131s\u0131yla TPAO, riskli alanlarda yeni teknolojilerle \u00e7ok say\u0131da arama yapmas\u0131 olanaks\u0131z bir \u015firkettir. Ge\u00e7mi\u015fte, Azerbaycan ve T\u00fcrkiye liderlerinin ki\u015fisel dostlu\u011fundan kaynaklanan Azeri-\u00c7\u0131ral\u0131-G\u00fcne\u015fli petrol gelirlerini saymazsak (\u015firketin bu \u00fcretim sahas\u0131nda % 6,5 kadar ortakl\u0131\u011f\u0131 vard\u0131r) \u015firketin yurtd\u0131\u015f\u0131nda hemen hi\u00e7 petrol geliri yoktur, yurti\u00e7indeki gelirleri yetersizdir, arama faaliyetine ay\u0131rd\u0131\u011f\u0131\/ay\u0131rabildi\u011fi miktarlar ise olduk\u00e7a k\u00fc\u00e7\u00fckt\u00fcr. En \u00f6nemlisi, petrol \u00fcretimi d\u0131\u015f\u0131ndaki alanlar i\u00e7in (iletim, rafinaj vs) organize de\u011fildir. Yan dallardan gelir olana\u011f\u0131 bulunmayan \u015firket, sondaj faaliyetlerine yeterince kaynak transferi de yapamamaktad\u0131r.\u00a0\u00a0\u00a0\u00a0\u00a0 <b>\u00a0\u00a0\u00a0\u00a0\u00a0 <\/b><\/p>\n<p style=\"text-align: center;\"><b>Sonu\u00e7<\/b><\/p>\n<p style=\"text-align: justify;\">Yeni petrol rejimi,\u00a0 iyi niyetli baz\u0131 de\u011fi\u015fiklikler \u00f6ng\u00f6r\u00fcyor, fakat as\u0131l gerekli olan yasa de\u011fi\u015fikli\u011fi de\u011fil anlay\u0131\u015f de\u011fi\u015fikli\u011fidir. Temelsiz korkular\u0131 a\u015fmal\u0131y\u0131z. Devlet ayr\u0131cal\u0131\u011f\u0131 yaratmak, art\u0131k ge\u00e7mi\u015fte kalm\u0131\u015f \u201ckapal\u0131 ekonomi\u201d tercihidir ve uyguland\u0131\u011f\u0131 d\u00f6nemlerde hi\u00e7 faydas\u0131n\u0131 g\u00f6rmedik.<\/p>\n<p style=\"text-align: justify;\">Petrol arama\/\u00e7\u0131karma faaliyetini t\u00fcm d\u00fcnya piyasalar\u0131nda ge\u00e7erli olan; ruhsat alanlar\u0131n\u0131\u00a0 \u00f6nceden dikkatlice belirlemek, isteklilerin teknik kapasitelerini do\u011fru bi\u00e7imde de\u011ferlendirmek, ruhsat sahiplerinin \u00f6n\u00fcne mant\u0131kl\u0131 i\u015f planlar\u0131 koyup buna uymayan\u0131n ruhsat\u0131n\u0131 hemen elinden al\u0131vermek\u2026. gibi kurallara ba\u011flamak yerine \u201cmilli menfaatlere\u201d yaslamak, zaten kolay a\u00e7\u0131klanabilir bir durum de\u011fildi.<\/p>\n<p style=\"text-align: justify;\">\u015eu anda 24 yabanc\u0131 ve 24 de yerli \u015firket \u00fclke topraklar\u0131nda petrol ve do\u011falgaz aramakta. Bu \u015firketleri \u00e7o\u011faltmak, onlar\u0131 daha \u00e7ok kuyu a\u00e7malar\u0131 ve pahal\u0131 yeni teknolojileri denemeleri i\u00e7in cesaretlendirmek gerekiyor.
